WEDDING PHOTOGRAPHY TERMS AND CONDITIONS
It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.
1 – Booking Fee
A booking fee of £300 secures the time and services of the Photographer for the wedding and is non-refundable or transferable in the event of cancellation.
2 – Payments
Following payment of the booking fee, the remaining balance is due is to be paid 4 weeks prior to the wedding. No photographs will be delivered until all payments due have been paid in full. Payment for additional images is to be made when they are ordered.
3 – Display
Igsam Creative Photography reserves the right to use the photographs for display, promotion and all other promotional purposes.
4 – Images
All image sizes are nominal. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record the exact colour as seen by the human eye.
5 – Reorders
All reorders shall be treated as an extension of the contract and no responsibility for error will be accepted unless orders are given in writing.
6 – Copyright
All digital files remain the property of the photographer. It is understood that the copyright of all photographs remains with Ignacio Sanchez (Igsam Creative Photography).
7 – License
Igsam Creative Photography grant the owner of digital file purchases, license to copy and to have prints made from them for non commercial use, copyright of the images remain the property of Ignacio Sanchez (Igsam Creative Photography).
8 – Travel Expenses
Reasonable travel and accommodation expenses will be charged for certain locations.
9 – Dinner
A meal will be required during the wedding – please remember to organise this with your venue.
10 – Force majeure or Act of God
Igsam Creative Photography is not liable for failure to perform its contracted obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster).
11 – Attendance
In the unlikely event of the assigned Photographer being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another photographer to attend your wedding on our behalf to undertake the wedding photography to his/her best ability.
12 – Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
13 – Cancellation
The Client may cancel this contract at any time by giving written notice to The Photographer but in doing so shall forfeit any monies paid (minus any production / albums costs). Cancellation less than 12 weeks before the wedding will result in the payment of the package one photography coverage (£685) to be paid in full.
